תקנון ותנאי שימוש

1. כללי. האתר הינו בבעלות Vessel, 329324925, שכתובתה קורנית 6 כפר ורדים (להלן: "וסל"). תנאי השימוש מסדירים את היחסים בין החברה לבין כל אדם או גוף הגולש או עושה שימוש באתר או במידע שבו (להלן: "המשתמש"). החברה רשאית לשנות את התקנון מעת לעת; הנוסח המחייב הוא המפורסם באתר במועד ביצוע הפעולה, ושינוי לא יחול רטרואקטיבית על הזמנות שבוצעו. הניסוח בלשון זכר נעשה מטעמי נוחות ומתייחס לכל המגדרים. מחירי המוצרים כוללים מע"מ כדין, והמחיר המוצג הוא המחיר הכולל; דמי משלוח יוצגו בנפרד ובאופן ברור טרם השלמת ההזמנה. תמונות המוצרים להמחשה בלבד. החברה אינה מתחייבת להחזיק במלאי את כל הדגמים, ורשאית להציע ולהפסיק מבצעים בכל עת.

2. הזמנה, קיבול ואספקה. ביצוע הזמנה באתר מהווה הצעה מצד הלקוח לרכישת המוצרים. הודעה אוטומטית על קליטת ההזמנה אינה מהווה קיבול, והעסקה משתכללת עם אישור החברה וחיוב אמצעי התשלום. נפלה טעות סופר מהותית וברורה בתיאור מוצר או במחירו, רשאית החברה לבטל את ההזמנה, ובלבד שתימסר ללקוח הודעה בהקדם ויושב לו מלוא הסכום ששולם. התשלום באתר באמצעות {אמצעי התשלום: כרטיסי אשראי / Bit / Apple Pay / PayPal}; רכישה בתשלומים כפופה לאישור חברת האשראי ולתנאיה.

3. כשירות משפטית. ביצוע פעולה באתר מהווה אישור של המשתמש ("הלקוח") כי קרא את התקנון ומסכים להוראותיו. השימוש מיועד לבני 18 ומעלה. קטין נדרש לאישור אפוטרופוס טרם פעולה, מבלי לגרוע מהוראות חוק הכשרות המשפטית והאפוטרופסות.

4. דין. על השימוש באתר ועל כל עסקה שתבוצע בו יחול הדין הישראלי בלבד. אין בתקנון זה כדי לגרוע מזכות הצרכן לפנות לכל ערכאה מוסמכת לפי דין.

5. קניין רוחני. האתר, התוכן, סימני המסחר, העיצובים וזכויות היוצרים שבו הם רכושה הבלעדי של החברה או של צד ג' שהרשה לה. אין לשכפל, להעתיק, להפיץ, לשווק או לייצר יצירות נגזרות מכל חלק באתר ללא אישור מראש ובכתב.

6. שימוש אסור. המשתמש מתחייב שלא לעשות באתר שימוש בלתי חוקי, לרבות מסירת פרטים כוזבים, פגיעה בפרטיות, העלאת תוכן מפר או פוגעני, שיבוש פעולת האתר, איסוף נתונים אוטומטי או עקיפת אמצעי אבטחה. החברה רשאית לחסום משתמש המפר תנאים אלה, מבלי לגרוע מכל סעד אחר.

7. חשבון משתמש. ככל שנפתח חשבון באתר, על הלקוח לשמור על סודיות פרטי הגישה ולעדכן את החברה בכל חשש לשימוש לרעה. החברה רשאית להשעות או לסגור חשבון במקרה של הפרת התקנון.

8. מבצעים וקופונים. מבצעים, הנחות וקופונים יחולו בהתאם לתנאיהם כפי שפורסמו ולתקופה שהוגדרה, ללא כפל מבצעים אלא אם צוין אחרת, ואינם ניתנים להמרה בכסף. אין בהשתתפות במבצע כדי לגרוע מזכויות הביטול לפי דין.

9. חוות דעת באתר. האתר עשוי להציג חוות דעת של לקוחות. החברה לא תפרסם חוות דעת מפוברקות ולא תסנן ביקורות באופן שמטעה צרכנים, אך רשאית שלא לפרסם תוכן פוגעני או מפר דין. בפרסום חוות דעת מקנה המשתמש לחברה רישיון להשתמש בה באתר ובערוצי השיווק שלה.

10. קישורים לצדדים שלישיים. האתר עשוי לכלול קישורים לאתרים חיצוניים. החברה אינה אחראית לתוכנם, לזמינותם או למדיניות הפרטיות שלהם.

12. זמינות האתר והגבלת אחריות. האתר ותכניו מוצעים כמות שהם (As-Is). החברה פועלת לכך שהמידע באתר יהיה מדויק ועדכני, אך ייתכנו אי־דיוקים או שיבושים בתום לב, והחברה אינה מתחייבת לזמינות רציפה וללא תקלות של האתר. בכפוף להוראות כל דין שאינן ניתנות להתניה, החברה לא תישא באחריות לנזק עקיף או תוצאתי הנובע מהשימוש באתר או מהסתמכות על תכניו. אין באמור כדי לגרוע מאחריות החברה לפי דין למוצרים שנמכרו ומזכויות הצרכן הקוגנטיות.

13. הפניות. מדיניות הביטולים, ההחלפות וההחזרים, מדיניות המשלוחים ועמוד "ביטול עסקה" מקושרים בתחתית האתר ומהווים חלק בלתי נפרד מתקנון זה. מדיניות הפרטיות מפורטת בעמוד הייעודי.

14. שונות. קבעה ערכאה מוסמכת כי סעיף בתקנון בטל או אינו אכיף — יתר הסעיפים יעמדו בתוקפם. הימנעות החברה מאכיפת זכות אינה ויתור עליה. החברה רשאית להמחות את זכויותיה לפי תקנון זה במסגרת העברת פעילות, ובלבד שזכויות הלקוח לא ייפגעו.

ייתכנו סטיות קלות במוצר. גווני מוצר עשויים להיראות שונה מעט בין מסכים, ואין בכך פגם. אין באמור כדי לגרוע מזכות הביטול לפי דין.
